Diane J. (DeeDee) Gleven, hereinafter referred to as Seller, agrees to sell, and
________________________________, hereinafter referred to as Buyer, agrees to buy
a Papillon puppy, AKC litter registration number ________________ , hereinafter referred to as the Dog, for the price of $___________.
Buyer has paid paid a nonrefundable deposit of $__________. Balance due, paid in full prior to delivery, $___________ Rec'd:
Seller guarantees the the Dog to be in good health at the time of delivery. Buyer is urged to have the Dog checked by a veterinarian within 48 hours of taking possesion. Buyer is also advised to avoid exposure to other dogs or places frequented by other dogs, for at least until 16 weeks of age and until all vaccinations have been completed. If within 10 days of Seller taking posession of the Dog, a veterinarian certifies the Dog has an illness which predates, or resulted from exposure prior to, delivery, Buyer may return the Dog, at Buyer's expense, for a full refund of the purchase price including deposit, or after conferring with Seller, Seller may agree to pay reasonable veterinary costs up to the amount of the purchase price. If this clause is invoked, Buyer and Seller shall agree how to proceed, according to what is best for the puppy. If within one year of Buyer taking possession, a veterinarian certifies in writing that the Dog has (not just a carrier) a genetic health defect, for example progressive retinal atrophy or patellar luxation (two common defects in Papillons) the Dog may be returned, at Buyers expense, for a full refund of the purchase price, or if seller elects to keep the Dog, Buyer agrees to pay documented veterinary costs specifically related to treatment of the identified defect, up to the amount of the purchase price.
Seller represents this Dog as a pet quality animal. It has no known disqualifying traits (according to the American Kennel Club breed standards) or
has a known disqualifying trait if stated here_______________________________.
It is not guaranteed to be without such trait. Seller makes no other representations about the Dog.
Buyer agrees to provide for the physical and social needs of the Dog, and recognises that pet ownership is a lifetime committment. Buyer will continue an appropriate vaccination schedule, according to the advice of Buyer's veterinarian, will maintain current rabies vaccination, and will license the dog in their local jurisdiction.
Buyer agrees never to turn the dog over to a shelter, or to sell it by raffle. If the dog becomes unwanted, or Buyer is unable to provide for it, Buyer may return the dog to Seller. No refund applies in this instance, although Seller may offer a refund if Seller deems it appropriate. Buyer will sign over all papers to Seller when returning the Dog.
Buyer assumes all responsibilities for the Dog's future health and welfare. Such things as personality conflict with the Dog, landlord disapproval, changes in the Buyer's circumstances, etc. are considered within the realm of pet ownership and invoke no responsibility from the Seller.
However, Seller remains interested in the welfare of the Dog, and encourages communication from the Buyer regarding its progress.
